More BAD NEWS For Chesapeake Energy and Fracking Industry

Golly Gee...just how bad can it get for Aubrey McClendon and Chesapeake Energy?  I mean Chesapeake Energy is struggling to avoid bankruptcy, Aubrey McClendon is under investigation, and has had to give up total control of the company, and the price of natural gas is in the toilet.  Could it get worse?  YES!  Seems a new peer reviewed study is once again proving the (un)Natural Gas industry has been lying to us in a BIG WAY...drum roll please...seems contrary to the (un)Natural Gas industry lies being spoon fed to the masses by the likes of Exxon Mobil and Cheseapeake Energy about how safe fracking is, contrary to their lies that our water is safe, that FRACKING can and will CONTAMINATE our underground water aquifers.

Are you reading this Governor Cuomo?  Maybe it is time we BAN FRACKING?

New Study Predicts Frack Fluids Can Migrate to Aquifers WIthin Years

Major news outlets such as Bloomberg News, Business Week and Propublica are reporting on a game-changing peer reviewed study commissioned by Catskill Mountainkeeper that predicts frack fluids can migrate into aquifers, directly contradicting the claims by the gas industry that these toxic chemicals will stay underground forever.

The new peer-reviewed study by hydrogeologist and researcher Tom Myers, “Potential Contaminant Pathways from Hydraulically Fractured Shale to Aquifers” published in the current issue of Ground Water, demonstrates that fluids from highly-pressurized gas drilling activities can migrate from deep subsurface layers of shale to shallow aquifers and surface waters, bringing along polluting gases, chemicals, and radioactivity. The study, based on computer modeling of pressure waves, rock characteristics, and fluid mobilization in natural and induced fissures, offers an explanatory mechanism for previous reports of contamination of wells by deep shale methane in multiple areas around Pennsylvania.


The study accords with detailed fracture maps produced by structural geologist Robert Jacobi, showing extensive fracturing of deep bedrock, including shale layers in the Catskills and across New York State.
 Hydrofracking and other high-pressurized drilling activities seek to exploit natural and induced fractures in order to release methane gas, but migration of contaminated gas and fluids through rock fissures cannot be managed or controlled, making slow contamination of aquifers and water resources – over time frames as short as one year – extremely likely in areas of intensive drilling activity. This threat from deep level contamination therefore points to risks inherent in high pressure drilling activities above and beyond the already existing threats to human and animal health posed by poorly drilled wells and dissolving cement sheaths and casings, which are already well-accepted as mechanisms by which drilling activities can ruin water sources.

Chesapeake Energy's Aubrey McClendon Modern Day Whimpy

There are a lot of terms one could use to describe Aubrey McClendon of Chesapeake Energy...flamboyant, egotistical, eccentric, brash, self-absorbed, shyster depending on your opinion of him, and the company he co-founded...but perhaps the simplest and most appropriate description of the man is to state he is the modern day Whimpy of Popeye fame, telling his investor's and those he seems to make deals with, "I'll gladly deliver you Natural Gas next Tuesday for a few billion today."

Hamburgers are Wimpy's all-time favorite dish, and he is usually seen carrying or eating one or more at a time – e.g. in Popeye the Sailor Meets Sindbad the Sailor he is seen grinding meat or eating burgers almost the entire time – however, he is usually too cheap to pay for them himself. A recurring joke involves Wimpy's attempts to con other patrons of the diner into buying his meal for him. His best-known catchphrase started in 1931 as "Cook me up a hamburger. I'll pay you Thursday." In 1932, this then became the famous "I'll gladly pay you Tuesday for a hamburger today". This phrase is now commonly used to illustrate fiscal irresponsibility and still appears in modern comedies such as The Drew Carey Show and The Office
In Aubrey McClendon's quest to corner the (un)Natural Gas shale plays, to push himself upward into a higher ranking of his billionaire status, he has basically conned investors, the general public and America.  Chesapeake for far too long now has been selling Whimpy's promise, telling investors "We'll gladly sell you a share of this play or that play, will gladly promise you a percentage of the whole when at some future date when it is drilled, if you give us X Billions of dollars today."  McClendon's plan it seems....double down, sell off promises (IE...the company wants to raise $2 Billion by selling a percentage of advanced sales of output in Texas and Oklahoma) of future deliverable s, or better yet, run out the company's cash reserves, deliberate push it into bankruptcy and come out the other end whole while all those who invested in the company take a blood bath.

Sadly, Aubrey McClendon seems to be the poster child for the (un)Natural Gas industry, the whole bloody lot of them prepared to say anything that gets them what they want...the right to FRACK at all costs anywhere and everywhere that shale can be found.  They have bought off politicians, spied (illegally) on those who oppose them, and spent tens if not hundreds of millions of dollars on a propaganda campaign worthy of comparisons to Adolph Hitler and the Third Reich.  How many of us have seen the commercial where Eric Oswald of Exxon tells us, "...we recognize the challenges, and how important it is to do this right".  Exxon and Chesapeake are the two biggest players in the (un)Natural Gas speculation game, the two biggest hucksters trying to sell America and the world on Horizontal Hydraulic Fracturing...can they, and the information they have provided to those who are supposed to be regulating them be trusted?

Chesapeake Energy's financial woes and questionable business practices should lead everyone to one logical conclusion...no, the industry cannot be trusted, and they will NOT GET IT RIGHT.  States like Maryland, Ohio and New York should simply pass a BAN  ALL HYDRAULIC FRACTURING FOR (un)NATURAL GAS...BAN FRACKING.  Problem is, we all know most politicians in positions of authority are as inherently dishonest as the Aubrey McClendon's of the world, each doing their own version of Whimpy as they tell campaign donors, "I will gladly pass laws that favor you when elected if you open up your wallets today." 

 Take our own governor here in New York...he's already bought into the Natural Gas scam, has already decided that extracting natural gas from the Marcellus Shale is far more important than the health of New York's citizens, far more important than our fresh water supplies, far more important than preserving our state parks and natural resources.

Wake up citizens...Whimpy was a CON MAN, and pretty much everyone involved in the (un)Natural Gas industry is no different than this hamburger guzzling character of Popeye fame.

PS...in breaking news of the too little too late variety....Aubrey McClendon is partially being pushed out at Chesapeake, being stripped of his role as Chairman.

(un) Natural Gas FACTOID

Due to falling natural gas prices, the nation's second largest gas producer, Chesapeake Energy, said it will slash drilling by nearly half...WHICH BEGS THE QUESTION, "Could Chesapeake Energy find itself going BANKRUPT? Might explain why they have sold off so much of America's natural gas to CNOOC (as in CHINA).

We're just saying...

One last question...if they are cutting their drilling in HALF, where are they coming up with all those FALSE jobs created numbers, and if drilling is cut in half, why not just BAN FRACKING here in New York?  I mean we help out Chesapeake by letting them NOT DRILL HERE, and we keep our water safe.  Win win situation right?

To Sullivan County and Town of Fallsburg Elected Officials...WHERE IS OUR FRACKING BAN?

Contrary to what Oklahoma based Chesapeake Energy would have us believe, FRACKING is not safe. Also contrary to what the (un)Natural Gas industry would have us believe, we have the ability to STOP FRACKING IN ITS TRACKS here in Sullivan County, have the ability to stop it here in the geographical footprint of the "Town of Fallsburg".  Two recent court decisions are MAJOR SET BACKS for the (un)Natural Gas industry, and big wins for local communities.
Simply stated, in two separate cases judges have ruled that banning fracking is a natural extension of a community's local government to control land use.
On Friday, Acting Supreme Court Justice Donald Cerio held that Middlefield, a town about 70 miles west of Albany, had the authority to ban gas drilling. The ruling came just three days after State Supreme Court Justice Phillip Rumsey dismissed Anschutz Exploration Corporation's bid to overturn a similar ban in the Ithaca suburb of Dryden, where the company owns leases on more than 220,000 acres of land.
Both judges held that the bans were natural extensions of local governments' authority to regulate their own land use.
Which begs the question of our own elected officials here in Sullivan County, both on the county level, and on the local level here in Fallsburg, "Where is our FRACKING BAN"?  It seems rather obvious that a majority of the citizens of our county do not want FRACKING, and politicians are elected to do the peoples business, not the business of the rich and elite.  So, where is our FRACKING BAN?

If our elected officials don't want to lose their deep pocketed supporters (donors) how about we put it up for a vote in the November Election?  No fancy words, just a straight up or down vote with the majority's wishes immediately adhered to.  It would be a David verse Goliath battle, and would bring some serious money into our county between now and December...can you imagine how much money the Natural Gas industry would spend trying to defeat the measure?  Chesapeake Energy, Cabot, Exxon all flooding Sullivan County with bodies, knocking on doors, buying full page ads in every print media outlet, and probably wanting to toss around money trying to BUY VOTES...imagine every little league team but one sporting the emblems of a Natural Gas company, the lone hold out sponsored by the Anti Fracktivists as we have been labeled.

I am opening inviting ALL OF OUR ELECTED OFFICIALS in Sullivan County to post to this article, and explain their position on Fracking clearly and distinctly, am asking each of you to tell us where you stand personally, and as our elected officials where you stand in this fight.  There is NO MIDDLE GROUND, you either support FRACKING and all the ills that WILL COME WITH IT, or you are opposed to it.  If you suupport fracking, we HAVE A RIGHT TO KNOW, and it will tell us just who we need target for defeat the next time you are up for re-election.

Again, where is our ban on Fracking, why haven't we passed zoning laws BANNING THIS SOON TO BE BLIGHT ON OUR COUNTY?

With All Due Respect President Obama FRACK OFF


Dear Mr. Obama...

With all due respect, FRACK OFF...you just lost my vote, my respect, and the right to expect me to see you as my President.  Go rape someone else's lands, contaminate someone other than myself and my community's water in the name of your National Energy Policy, in the name of the Natural Gas industry.  Times have changed, and we have heard both Dick Chaney, and Vice President Biden drop the F-Bomb...so, FUCK OFF OBAMA...you just sold out to the Natural Gas industry, just showed yourself a demon spawn of the worst kind, a Republican in Democrats clothing.

Fracking is NOT BEING DONE SAFELY, and as for the government developing the technology...you mean like the time that the DOE tried Atomic Fracking, detonating a nuclear bomb in the hopes of freeing up Natural Gas trapped underground?  The gas so contaminated as to be unusable...refined technology...the kind that contaminates our drinking water, causes untold THOUSANDS of cancer cases, but leaves the Natural Gas usable, ready to be SOLD TO CHINA.

If you think you can ruin our communities, poison our lands, spoil our waters, and visit death upon our children by clearing the road for wholesale fracking with the stroke of your pen Mr. Obama, you are wrong, and the Anti-Fractivists, those in the Occupy Movement will show you we have far more backbone for this fight than you are giving us credit for.  When you get your head out of the ass of Chesapeake Energy, Cabot oil, when you grow tired of pandering to special interests in the name of a second term, perhaps the two sides can talk, but till then, you have just put yourself in a position of BEING AGAINST THE WILL OF THE PEOPLE.

The Latest Fracking News

First Up...if you have not yet submitted comments to the NYDEC opposing the inadequate fracking regulations found in the SGEIS, now is the time to do it (deadline is January 11th...this upcoming Wednesday) is now. To make it easier for citizens to submit comments, Catskill Citizens has put up a page with 20 READY TO GO comments here. They are great comments, but if you want some serious IMPACT to your statement, want to have it receive MORE ATTENTION, it is recommended you use their suggested comments as a model to write your own. The more the merrier, so consider to some or even all of them! As a stakeholder, it is also recommended you ask to be put on the document SERVICE LIST.

Next up...is the US EPA going to start delivering water to the citizens of Dimock, Pennsylvania? Cabot has reneged on doing right by the citizens of Dimock, even though they are the guilty party that has contaminated the community water, and sadly, the state of Pennsylvania's own DEC is letting them get away with it...however, all is not lost. Seems that the US EPA is weighing to their own investigations, and bringing in water.
If the EPA delivers water to the village, it would be the clearest sign yet regulators are concerned about the effect of drilling on drinking water there.
Dimock may become pivotal in a national debate about the environmental impact of fracking, the drilling technique that could unlock decades' worth of natural gas trapped in shale deposits, but which environmentalists say contaminates water supplies.
11 minor earthquakes in Ohio attributed to FRACKING. First, this raises some serious question about allowing fracking anywhere near any earthquake faults. More importantly, it raises a much more serious question...why is the Hydraulic Fracturing industry being allowed to DUMP THEIR CANCER CAUSING WASTE STREAMS into the ground with our potable water supplies. Seriously, how safe can it really be to be dumping all these toxic chemicals into the ground, and will not those toxic chemicals PERCULATE up into the aquifers if said chemicals are causing earthquakes?
Now, seismologists have attributed a recent series of 11 minor earthquakes in Ohio to injection wells that disposed of wastewater byproducts from fracking operations.
Will opponents of Fracking here in New York be successful in getting another one year moratorium on the dangerous industrial drilling practice known as Hydraulic Fracturing, or would such a moratorium amount to putting lipstick on a pig. As it is, the DEC cannot issue permits before 2013, as there is no money in the budget for the added employees needed to enforce the proposed rules moving their way through the process now. Symbolically it would be a big victory for the Anti's, but we need to make sure it is not window dressing meant to appease.
Pointing to experiences in other states, including Pennsylvania and Colorado, critics say the practice could contaminate drinking water and air, cause small earthquakes and lower property values. Supporters say allowing fracking in New York would create an important domestic source of energy and thousands of jobs for depressed rural areas.

State Assembly Environmental Committee Chair Robert Sweeney said on Friday he would soon introduce a proposal to have a moratorium on fracking until June 1, 2013. Sweeney pointed to recent reports that fracking may have caused a series of small earthquakes in Ohio and contaminated drinking water in Wyoming and Dimock, Pennsylvania.
Bottom line is simple...at every step of the way, Fracking seems to get more dangerous, and at some point politicians and regulators have to accept that some risks are not worth taking, and Hydraulic Fracturing is one of those risks that small rural communities like our own cannot afford to have the DEC force us into accepting. How many examples of problems do regulators need to have presented before they just tell the Exxon's, Cabot's and Chesapeake Energy's of the world NO?

Dick Cheney, Halliburton, both make most Americans cringe. Well, get ready to cringe...seems that Haliburton stands to reap lots and lots of profits from...drum roll please...increased North American FRACKING ACTIVITIES. Have any of us known Haliburton to do anything RIGHT? Can we all quickly go back to the Gulf Oil Rig explosion and collapse, remember that Halliburton is now accused of DESTROYING evidence?

New Yorkers ask yourselves...do you really want hundreds of thousands of Natural Gas wells being drilled and maintained in our state by HALLIBURTON?

Sullivan County, State of New York Risk Our Water For China?

I have in previous articles alleged that Natural Gas companies like Chesapeake Energy, Conoco Phillips and Exxon have no interest in ending America's reliance on foreign oil, have no interest in providing Americans with a cheap source of fuel for their cars. If one follows the money, two basic facts were clear...before the Marcellus Shale here in New York has been radically drilled, many companies were selling huge stakes to foreign countries (CHINA), and while getting politicians to give huge subsidies to the industry, these companies are using their own money to invest in very large expensive LNG EXPORT facilities to send our Natural Gas abroad (CHINA...CNOOC).

ExxonMobil Chairman and CEO Rex Tillerson sees “very strong future demand globally” for natural gas, which he said, will be the “fastest growing” among fossil fuels until 2040.

Which should beg the question, should Governor Cuomo, the NYDEC be risking our environment, our water, our health here in New York so that companies can export said natural resource to China? The reality of these large and expensive LNG EXPORT facilities pokes a huge hole in the propaganda that the Natural Gas industry has been feeding us...truth be told, they have NO INTENTION of getting America off of foreign oil, and if truth be known, they know that Natural Gas is not going to be the cheap alternative fossil fuel they keep touting to us, and to states like Pennsylvania who this year approved $50 million in subsidies for things like governmental vehicle fleet change over to Natural Gas.
Rich Gordon of Gordon Energy Solutions, a research firm in Overland Park, Kan., estimated that since 2005, domestic and overseas operators have spent $135 billion securing shale gas acreage in the U.S.
Start doing the math people, look at where the gas is REALLY GOING TO GO, and ask yourselves the all important question, "Are you willing to risk your health, your safe drinking water supplies for China? How many acres of land do companies like Chesapeake Energy already have the rights to drill under? How many acres in addition to the ones they own will the state of New York allow them to drill without buying rights through forced pulling?

Fact is, our Natural Gas that is SUPPOSED TO GET US OFF FOREIGN OIL is already leaving America, and in a BIG WAY. LNG exports rose sharply to 42.4 billion cubic feet the nine months ended Sept. 30, up from 34.5 billion cubic feet for all of 2010, and these Natural Gas companies want to rape our lands, spoil our safe drinking water supplies to get at the Marcellus Shale Gas for one reason, and one reason only...EXPORT. We need to tell Governor Cuomo to BAN FRACKING in New York, but we also have to cut this industry off at the knees by opening up a second front on the regulatory front...DOE FOLKS....and... the (FERC) Federal Energy Regulatory Commission. We can stop them from getting Federal Government permission to EXPORT OUR NATURAL RESOURCES. We need to be filing comments and objections ON EVERY PERMIT REQUEST...this is a WAR TO SAVE OUR WATER. The real BATTLE LINE!

NYDEC Hydrofracking Hearing One BIG Dog and Pony Show

Wanted to hold off on this article until the hearing down in New York City was held yesterday. If I were to adhere too Thumper's sage advice, "If you can't say something nice, don't say nothing at all" this article would end right here. The natural gas industry, and the New York DEC should both be ashamed of themselves.

I arrived at the Sullivan County Community College campus a little after ten in the morning, the rain pouring from the sky in buckets. First thing I noticed, was the Natural Gas Industry had spent a LOT OF MONEY trying to stack the deck at the hearing, thinking one might guess that might makes rights. They had a white event tent set up, had BUSED IN scads of bodies, and were feeding them all breakfast. There was a portable bill board truck parked in a highly visible fashion shouting out their propaganda for all to see. Parking my car, got my camera and starting taking pictures until several large burly UNION MEN said, "You're not welcome ASSHOLE". As Snagglepuss used to say, "Exit stage right even", and that is exactly what I did, snapping a few more pictures before retreating to the safety of my car.

Sure some will want to know how it is that I knew these men were union men...first, that has for decades been a tactic employed by large corporations at hearings of this nature. They routinely use union members who are beholden to them for a paycheck to create artificial support of their positions. Secondly, one of the union members at the public hearing was at this hearing, and he told me flat out he was there because his UNION told him to be there...privately, this man is against fracking, but at the hearing, he was there to be a supporter of Hydraulic Fracturing because he was ordered to be. Can hear some of you going WTF...even worse, every regulatory agency in America sworn to protect human health and the environment knows this too be true, but they turn a blind eye to the reality in front of their eyes, and let these Union workers provide statements of support that become a part of the PUBLIC RECORD...perhaps that explains why said hearings NEVER TAKE SWORN STATEMENTS.

I parked my car in a more appropriate space, and made the hike to the hearing in the pouring down rain, wrongfully assuming that once at the building I could come in out of the rain...WRONG. Even though there was a perfectly good and dry building there in front of all of us, and even though the hearing was in a theater that had a SEPARATE SET OF DOORS, the DEC did not want any of us inside the building...so, they had a large police presence BLOCKING THE DOOR, making all of us stand outside in a TORRENTIAL RAIN STORM for almost two full hours, finally letting all of us drown rats into the building at just after noon.

Even worse...which most of us did not know until we were inside the building, is that the NYDEC had DELIBERATELY CHOSEN a auditorium that only sat 250 people. Imagine standing in line in torrential rain for over two hours only to be told, "Sorry, you cannot go into the auditorium, as we are at capacity...HOW CONVENIENT.

In the meantime, some shrew from the NYDEC came outside and selectively started giving out cards...if you were fortunate enough to receive one of these cards, you were (supposedly) guaranteed a chance to make a comment on the public record at this hearing. They had figured out just how many people they would be able to hear in the three hour afternoon hearing, and handed out cards based on that number...problem is, once the hearing started, once all the public officials were heard, once some more public officials showed up later, but allowed special privileges, it became obvious that not everyone who had been given a card was going to get a chance to speak. Something was going to have to give, including FAIRNESS...the person in charge of the cards started doing some shuffling of the deck, started some picking and choosing as they selectively started choosing who the last speakers would be, leaving the rest on the table, our voices silenced.

How do I know this...I was one of those tossed aside, one of the voices who would not be heard from in the afternoon session. Seeing what was going on, I went out into the hall to make a formal inquiry with the staff...I was told, "Sorry, but we just are not going to be able to get to everyone, but you can submit written comments instead if you would like."

I made what I thought was a reasonable suggestion...since I filled out the card, since I stood out in the rain for almost two hours to have that chance, wouldn't it make sense to let the 26 of us who stood out in the rain be the first speakers at the EVENING HEARING? They found that totally unacceptable, told me that the evening session was a completely SEPARATE HEARING, and if I wanted to speak at that session, I needed to go back outside (in the rain) and stand online again, get a NEW CARD, fill it out and then and only then could I have a second chance to speak.

Now, while we were having this discussion, another member of the staff had run off and showed back up with a POSSE of uniformed officers who SURROUNDED ME IN A VERY MENACING MANNER, one of they tapping me on the shoulder and suggesting it might be wise if I took the NYDEC direction, and went outside to wait in line in the rain. I had made no threats, had not used a single vulgarity, yet found myself surrounded by some six GUN WIELDING POLICE OFFICERS, some of them I am sure equipped billy clubs and mace...I excused myself, and went outside into the rain to wait for a SECOND CHANCE to fill out a card so that my voice could be heard.

In the hearing itself, several things became very clear.

Despite their best efforts to stack the deck, it was obvious that those supporting Hydraulic Fracturing were out numbered...they had succeeded in having ten from their side first in line, so once the politicians had spoken, they got to speak their voice first. Funny thing though...the ANTI's (that is the label assigned us by those in the Natural Gas industry) actually had our concerns expressed quite eloquently by the elected officials...all but one of them making it very clear that they OPPOSED FRACKING, end of story.

Those that spoke in favor of fracking all had very vested interests in seeing Hydraulic Fracturing moving forward here in New York...to a one, they were either landowners who had already sold out to the industry, and were waiting to reap the financial benefits, or they worked in the industry.

Those who were landowners had pretty much one rally cry, "Frack Baby FRACK" and one could almost see Sarah Palin leading the chant after wrapping herself in the red, white and blue. The industry folks were very dull and droll, delivering canned remarks all aimed at seeing the document under review GREATLY WEAKENED, their primary coal to greatly decrease or even eliminate the set backs that do not go far enough in protecting our water and environment.

The judge was an anorexic looking woman of pursed lips who seemed to spit her words out at us, relishing in her authority. Even though she works for the DEC, regularly interacts with other departments in the DEC, dines with them, stays in the same hotels with them, she went to great lengths to present herself and her department as being fully independent, and capable of making a unbiased decision on all the facts as presented to herself, and her staff...question there Ms. Judge lady, "If, as your words stated, you are so unbiased how is it that you never once told us to behave when the Pro Hydraulic Fracturing members in the audience made noise or applauded, but always called our side on the carpet when we did the same?"

For the record, this same unbiased adjudicator of the facts not only corrected and chastised one side, but went so far as to bring in the police to remove one of our sides members for doing nothing more than dozens of Pro Hydraulic Fracturing citizens had done throughout the hearing...so much for unbiased.

It was obvious that most people at these hearings are opposed to fracking, or oppose it until it can be done safely. It was obvious that everyone, including all but one politician want a comprehensive assessment done...something we should as stakeholders be entitled too, but something both the DEC and the Natural Gas industry are opposing...uhhh...curious here why the DEC and the industry would opposed a study that would show us the FULL PICTURE? Could it be, that by compartmentalizing the entire process, by segregating the various and assorted risks you can find a way to justify allowing FRACKING, but by doing a comprehensive study, showing New Yorkers the FULL AND TRUE COSTS of the entire process you know that drilling WOULD NEVER OCCUR in the Marcellus Shale? Come on Ms. Judge Lady, you can tell me, I promise to keep it a secret....who paid you and the DEC off? We know they have bought Governor Cuomo off, and guessing here that a backroom deal has been struck between the DEC and the Natural Gas industry as well.

In the evening hearing, one of the first speakers was an industry paid hack by the name of Tom who spoke in favor of weakening the already weak regulations. I would strongly encourage every elected official in Sullivan County to contact YNN. Get a copy of the video, and listen to this mans opinions on our county. His words alone should convince you that FRACKING SHOULD NEVER BE ALLOWED IN OUR COUNTY....Tom is a MAJOR PLAYER in the Hydraulic Fracturing industry, and he made it so very obvious how much he LOATHES Sullivan County. He is the poster child for the Pro Hydraulic Fracturing crowd, was surrounded by his cronies, and if you listen to his words made ON THE RECORD, it should be pretty clear that they want to drill our county AT ALL COSTS, but hold NO RESPECT FOR US...is that what we really want?

In the end, it was a typical DEC dog and pony show. They had and have no real interest in hearing our concerns, and will put no weight in them when the decisions is made(whoops...that's right, the decision has already been made). They hold these hearings as window dressing, it allows them to assuage their own guilt, allows them to pat each others backs as they smile and say,"See, we gave the little people their chance to be heard, now, lets go back to our hotel and order steak on the taxpayers dime."

DEADLINE EXTENDED!

On what was supposed to be the last day of public comment hearings on the Draft SGEIS, the Cuomo Administration's plan for fracking New York, it was announced that the deadline for submitting written comments on the Draft will be extended by another month, until January 11th.

This is our third big win in a month. Just a few weeks ago DEC Commissioner Martens announced that the DEC probably wouldn't be able to begin issuing drilling permits in 2012, and just last week the Delaware River Basin Commission temporarily dropped plans to adopt drilling regulations for the Basin.

All these delays are undoubtedly a response to the widespread and increasingly vocal opposition to fracking, but they are also evidence that even the highest levels of government are beginning to wake up to the unprecedented risks posed by high-volume fracking. Shortly before the DRBC cancelled plans to vote on regulations, Delaware Governor Jack Markell released a powerfully worded letter that made it clear he's unwilling to jeopardize the drinking water supplies of the residents of his state.

Sure if I told you that the governor instructed staff to have two sign up sheets...one inside the room for PRO NATURAL GAS FOLKS, and one outside for ANTI FRACKERS (who were not allowed in to sign the other sheet), and told you that they then called up folks from the FIRST LIST ONLY, you would say I was a conspiracy nut...well, watched the video, and you decide. FACE IT FOLKS, WE ARE BEING RAIL ROAD'ED TO HELL ON A FRACK HIGHWAY.

Chesapeake Malfeasance CREATES EMERGENCY as 1,000's of GALLONS of Chemically Contaminated Fracking Fluids Ruin Farm Land, POISON LOCAL CREEKS! HAPPENING NOW

 
Chesapeake Energy, who sure seems to have a LOT OF ENVIRONMENTAL VIOLATIONS seems to have a major catastrophic emergency on its hands in Bradford County, PA.  The company who insists that FRACKING has never damaged ground water can NEVER AGAIN SAY THOSE WORDS, nor can the industry.

A Fracking Well GONE WILD over night has literally poured TENS OF THOUSANDS of gallons of highly dangerous, poisonous fracking fluids onto the farm land in this once picturesque area, the volume of the chemicals so large that it has FLOODED INTO THE NEARBY CREEKS AND STREAMS, with the damage to Ground Water sure to be immense.  The deadly chemical mix is so lethal to both animals and humans that nearby residents HAVE BEEN EVACUATED.

A Chesapeake Energy spokesperson said, "thousands of gallons of fluid leaked over farm land and into a creek from a natural gas well in Bradford County."  The timing could not be worse, as President Obama just yesterday had said, "If we are going to do this, it has to be done in a way that does not POISON PEOPLE."  TOO LATE!
First responders, and other qualified personnel in a all hands on deck NATIONAL EMERGENCY are desperately trying to contain the spill of these deadly chemicals as the FRACKING FLUIDS continue to flow unabated from the WELL PAD.
The blowout occurred on the Morse family farm in LeRoy Township outside Canton, a farming community who probably jumped at the money when the landman showed up, lease in hand with his slick sales pitch...that easy money for Randy Morse who ran cattle on his land is NOT SO EASY NOW, as he and his family will NEVER AGAIN be able to drink from the brook on his land that Chesapeake Energy has forever poisoned.

Chesapeake Energy official Brian Grove trying to put lipstick on a pig said "A piece of equipment on the well failed.  Now a major response is underway to stop the leak of frack fluid and get control of the well. We've been able to limit the flow. We're still doing additional work to regain full control,"   NOTICE HERE FOLKS, that the well is STILL GUSHING dangerous deadly chemical laden toxic FRACKING FLUIDS into the environment, threatening both SAFE DRINKING WATER AND HUMAN HEALTH!


Mr. Grove went on to say, "There is no telling yet how much of that extremely salty water mixed with chemicals and sand has impacted the nearby Towanda Creek, but no gas has escaped into the air."  Can't you almost hear him saying under his breath, "Yet".

Neighbor Ted Tomlinson said "The biggest thing is the footprint on the environment. Well obviously this is a big footprint."   Thanks to one neighbors GREED, a entire community is NOW SUFFERING, PAYING THE ULTIMATE PRICE FOR (un)Natural Gas FRACKING...for those not liking the tone of this article, too bad.  We have tried to WARN YOU, and now people like TEd Tomlinson are worried that their SAFE CLEAN DRINKING WATER that is just a few football fields away from this poorly managed and installed Chesapeake Energy Drilling Well has FOREVER BEEN RUINED.  It is noted here, that the IMMEDIATE HEALTH RISK IS SO SEVERE that Ted Tomlinson was forced to evacuate he and his family from their home

ASK GOVERNOR CUOMO TO CLOSE THE VERTICAL- WELL LOOPHOLE!


Upon taking office, Governor Cuomo reaffirmed Executive Order 41, which bars horizontal high-volume fracking until the DEC releases a final Supplemental Generic Environmental Impact Statement. But, as we recently discovered, the industry has already been using high-volume "slickwater" fracking to develop vertical wells.

Whether injected in horizontal or vertical wells, huge quantities of fracking fluid pose the same serious risk to public health. Ask Governor Cuomo to close the vertical- well loophole by amending Executive Order 41 to bar all high-volume and all slickwater fracturing until the SGEIS is completed.

BILLS, BILLS, BILLS
No, we're not asking you for money! We're talking about Albany. The legislature is now awash in bills that would prohibit, postpone, or regulate fracking.
But are any of them going anywhere? Maybe not. At least not any time soon. We're told that the Assembly and Senate leadership intends to wait for the release of the Revised Draft SGEIS before attempting to regulate high-volume horizontal fracturing. "Give (DEC Commissioner Joe) Martens a chance to present his plan" seems to be the prevailing attitude.
But while the DEC continues to wrestle with the SGEIS, vertical fracking continues unabated. That is why bills that would regulate operations already underway in the state, need to be considered now.

END THE OIL AND GAS INDUSTRY'S "HAZARDOUS WASTE" EXEMPTION
None of the pending bills is more important than A07013/S4616. It would overturn the law that exempts oil and gas waste from being classified as "hazardous," no matter how toxic and radioactive the material may be.
It's only common sense to classify waste according to the danger it poses, rather than according to the industry that produces it, but we can expect fierce resistance from the gas lobbyists. No doubt they'll complain that it's unfair to expect them to obey same laws that apply to every other industry!

THIRTY THOUSAND CITIZENS, AND ONE ATTORNEY GENERAL
Just days after citizens submitted thirty thousand written comments about the Delaware River Basin Commission's bone-headed plan to frack the watershed that provides fifteen million Americans with their drinking water, New York State Attorney General Eric T. Schneiderman announced that he would sue the federal government unless it agreed to conduct a full environmental review of the plan. All in all, it appears it will be a long, long time before the frackers have their way in the Delaware Basin.

IT'S OFFICIAL: SHALE GAS IS DIRTIER THAN COAL!
The long awaited report "Methane and the Greenhouse-Gas Footprint of Natural Gas from Shale Formations" has been published in Climatic Changes Letters. And the conclusion should be eye-opening for anyone who ever fell for the line that shale gas is a "clean" fuel.

The [greenhouse-gas] footprint for shale gas is greater than that for conventional gas or oil when viewed on any time horizon, but particularly so over 20 years. Compared to coal, the footprint of shale gas is at least 20% greater and perhaps more than twice as great on the 20-year horizon and is comparable when compared over 100 years."

 

Draft versions of this report by Cornell professors Robert Howarth, Renee Santoro, and Anthony Ingraffea have been circulating for more than a year now; this final version is the first peer-reviewed study of the subject.

Imagine Your Child with MELTING SKIN

Holy CHIT BATMAN...have you read the report on the list of Chemicals being used by at least fourteen of the MAJOR COMPANIES involved in the United States Natural Gas Hydraulic Fracturing debackle...you know, the practice the industry says is SAFE, and WILL NOT HARM US OR OUR WATER?

Setting aside the hyperbole and getting serious here...imagine a chemical so DANGEROUS that just one drop COULD KILL YOU!  Imagine that chemical being LABELED by a department of our Federal Government as a chemical terrorism agent.  Now, let your mind wrap around this reality...companies involved in the FRACKING OF OUR LANDS using this chemical as a part of their proprietary batch of chemicals that they PUMP INTO YOUR LAND in the process of extracting Natural Gas.  Sound scary? Well ladies and gentleman, IT IS TRUE.

Over a five-year period from 2005-2009, companies used more than 2,500 hydraulic fracturing products containing 750 different chemicals and other components, including chemicals that are known or possible human carcinogens or are federally regulated because at certain levels they are known to be quite harmful to human health--such as benzene, lead, and diesel fuel.  From the NRDC Switchboard

  • Two fracking products contained hydrofluoric acid (hydrogen fluoride in water). According to the Centers for Disease Control and Prevention, "You could be exposed to hydrogen fluoride if it is used as a chemical terrorism agent." My colleague Briana Mordick, NRDC's Science Fellow and a geologist, explained to me that hydrofluoric acid can eat through hard rocks. According to the CDC, swallowing only a small amount of highly concentrated hydrofluoric acid or even splashes of hydrofluoric acid on the skin can be fatal. It can cause a wide range of very serious health effects. 
  • Many of the fracking fluids contain chemical components that are listed as “proprietary” or “trade secret,” so the public cannot know what chemicals are being stored, used, or disposed of in their communities or near their drinking water sources.

Fracking fluid ingredients have been kept secret by the oil and gas industry for years. Efforts to shed light on the contents of these fluids are now taking hold, with Wyoming and Arkansas passing new rules to provide public information. But oil and gas is produced in more than thirty states, and disclosure in two states is not enough. Communities in every state deserve disclosure of chemicals and federal regulation of hydraulic fracturing.

This latest report importantly exposes more data that underscore the essential need for more scientific investigation as well as stronger regulatory oversight of the fracking process. Industry may continue to claim there is no documentation that drinking water has been contaminated by the fracking process, but that may be because no one has ever fully investigated the process and its effects. We know enough about the risks of the chemicals used and the many potential ways they can affect drinking water sources to warrant regulations that apply nationwide.

Legislation has been introduced in the U.S. Senate and the U.S. House of Representatives that would ensure federal regulation of hydraulic fracturing. The legislation is called the FRAC Act (its formal name is the Fracturing Responsibility and Awareness of Chemicals Act). NRDC makes it easy for you to write to your Senators and Representatives and ask them to co-sponsor this legislation on our website.

Students say to New York: Jump on the BAN Wagon
Coalition Stands Up for Clean Energy Future, Demands Ban on Fracking

On Wednesday, April 20 from 12:30 to 2:00 p.m. a coalition of student activists from NYU, the New School, and other universities will rally in Washington Square Park for a statewide ban on hydraulic fracturing, or fracking, the dangerous process by which natural gas is extracted through the pumping of high volumes water, sand and chemicals below ground. Hosted by Oxfam Club at NYU, the Students Against Fracking coalition will be joined by former Commissioner of the NYC Department of Environmental Protection Al Appleton, activist performers Reverend Billy and the Earthaluja Choir, student performers, activists and representatives to press the state legislature and Gov. Andrew Cuomo to replace the existing moratorium on fracking that expires on July 1st with an all-out ban.
“As students, we’re concerned that there won’t be a future for us in New York after we graduate if our water supply is contaminated because of fracking,” student activist Ben Davalos said. Several companies have already applied for permits to drill in the Delaware River Basin, a primary source of drinking water for New York.

Millions of gallons of chemicals, such as benzene, a known carcinogen, have been injected into wells in the U.S. in recent years. Between 2005 and 2009 14 of the leading oil and gas companies engaged in fracking used more than 2,500 products containing 750 chemicals and other components. Twenty-nine of the chemicals used are either known or possible human carcinogens, regulated under the Safe Drinking Water Act or considered hazardous air pollutants. The dangerous cocktail of chemicals used in the process enjoys many exemptions from federal regulations.

Because of the hazards demonstrated by this drilling practice in other areas, Students Against Fracking and its allies are calling for a statewide ban on hydraulic fracturing until it is proven safe. Communities such as Quebec and Buffalo have already passed bans on fracking, which is why the students are calling this rally “Jump on the BAN Wagon, a call for New Yorkers to join the global awakening to the dangers of this unsafe extraction method.

First, political correctness is killing America...so if the title of this article, the tone of the writing offends someone, do apologize in advance. Politics in America is still a white, rich mans sport (White Privilege should be changed to RICH WHITE PRIVILEGE, or just RICH PRIVILEGE) for the most part, and if you do not believe me look at some simple facts.  At every level of government, we have more millionaires and billionaires than ever before, most of them stuffed shirt white men who have bought themselves a SEAT AT THE TABLE.  In New York, we have Billionaire Mayor Bloomberg as a perfect example...when he wanted to stay in office longer, he used his MONEY to change the law.  Our current President is expected to spend a billion dollars trying to get re-elected in 2012, and if his silver tongued self promoting self is too be believed, goofy haired Billionaire wheeler dealer man Donald Trump is going to run for the office of President himself.  

Secondly, because I want to set the stage, and voicing just my own opinion here, prejudice and bigotry are expertly manipulated tools of the UBER RICH used to keep our collective focus off of themselves, and on each other as we seek someone to blame for our own plight...maybe, just maybe it is time for those in the middle and lower class to realize our problems are caused not by peoples of a different race, color or sexual orientation, but by those holding well over ninety percent of America's wealth, while expecting us far too often to work for slave wages, while our taxes are used to subsidize the industries of the UBER RICH, with (un)Natural Gas just the lastest example of how our land, communities, water and health are attacked in the name of WEALTH BUILDING, the people in power thinking nothing about visiting Environemental Racism on those communities who cannot AFFORD TO PROTECT THEMSELVES.

There is a blog article talking about Republicans in Pennsylvania keeping Pennsylvania Shale Gas in the state to benefit the people of the state through a set of incentives (paid for with YOUR TAXES).   Though the number will grow, right now over $47 Million state tax dollars would go to support the Shale Gas industry, and their building of infrastructure...this, even though lunatic Governor Corbett and his Robber Barons are refusing to tax even ONE DROP of the (un)Natural Gas coming out of the state.  These incentives, the package of seven House bills, known as Marcellus Works, would use tax credits and grants to expand the number of natural gas-powered vehicles on the state's roads, the theory being more Natural Gas vehicles would thus keep more of the Natural Gas at home in Pennsylvania.  Another part of the bill would provide money to the industry to build (un)Natural Gas stations all along the Pennsylvanian Interstate system...could someone explain to all us poor people why our taxes are being given to UBER RICH PEOPLE to use to build gas stations to sell us gas they took/stole from our lands?

These incentives MAKE NO SENSE...more importantly, they are based on a FALSE PROMISE.  Supposedly, these incentives will keep Pennsylvania Marcellus Shale Gas in Pennsylvania.  Do this dishonest politicians do ANY HOMEWORK AT ALL?  Do they know, are they aware of just how much of our American Shale Gas leases have already been sold to FOREIGN INTERESTS, with the largest purchaser of our Shale Gas resources being none other than COMMUNIST CHINA, who also happens to be the holder of most of our American Government's DEBT.  

If any one is foolish enough to believe China (through wholly owned companies like CNOOC) is buying up massive mineral, gas and oil rights as just a good investment, you are either A) living under a rock, or B) devoid of patriotism, and caring only about lining your own pockets with GOLD...most politicians fall into this later category.  China has a population of BILLIONS, and their people have gotten a taste for this flawed MASS CONSUMPTION economic model that is raping the earth, and with every passing day, the citizens of China are demanding more and more access to goods, and in that demand consuming an every increasing amount of the Earth's dwindling stockpile of natural resources, and the Central Communist Committee in China is doing everything in their power to corner the market on the world's most precious (and limited) natural resources, both Gas and Oil being on that list.

Would like to have some of these politicians explain to us how incentives to keep our resources at home is not MONEY DOWN A RAT HOLE, when these same politicians are doing NOTHING to keep companies like Cabot and Chesapeake Energy to buy up leases, bundle them and sell them off to foreign companies like so much graffiti as the (un)Natural Gas industry races down the same road of despair that the Home Mortgage business ran down not that long ago.  We do not need Natural Gas welfare, do not need to be offering incentives that make no sense.  We need ENFORCEMENT, and we need laws that PRESERVE America's resources FOR AMERICANS...a simple fact that the Natural Gas industry cannot refute, "If a national law were passed tomorrow nationalizing America's Shale Gas reserves for reasons of National Security, if that law forbid the outsourcing of this commodity, the BOTTOM WOULD INSTANTLY FALL OUT OF THE AMERICAN NATURAL GAS MARKET"...why?  Because what is driving the industry is not our own market here at home, but the world demand for what will soon be a scarce resource.

So far, politicians and the Natural Gas industry have just what they want...local governments, state capitals and Washington DC paying lip service to their constituents while PAVING THE ROAD of the Natural Gas industry with Gold (with our taxes) while locally, we have neighbors fighting neighbors, as one group hopes to cash in, get a small slice of the pie, while the other fights to preserve our lands, water, environment and health. It is time that WE WAKE UP...time that we stop letting the UBER RICH manipulate us, pit us one against the other, and instead start looking at the true root of our problems here in America...a system gone bad, a government that no longer listens to and represents the will of the people.

200 plus years ago we rose in protest (Boston Tea Party) over taxation without representation, fought a war to gain our Independence from England.  Now, two centuries later, we have lost our way, are so stuck in our own morass to be bothered with problems larger than ourselves.  If we want to see true democracy in action in 2011, we have to look to the Middle East where average every day people are joining together in common goals, in a unified voice as they throw off their own chains of oppression.  Natural Gas and all that it represents is the POSTER CHILD of just what is wrong right now in America, and we are running out of time to stop this runaway train, running out of time to SAVE AMERICA.  

We cannot win this war, cannot stop the raping of our lands one small community at a time and the (un)Natural Gas Industry, our own politicians KNOW THIS...we need a National Movement, and played right, we have the power to MAKE THAT HAPPEN.  How many small communities have small Anti-Fracking groups and organizations fighting their own wars against Goliath, and how many of those communities ARE LOSING THE FIGHT?  What happens if we all start linking up together to form one NATIONAL ORGANIZATION, one NATIONAL MOVEMENT to fight the (un)Natural Gas industry, their lobbyists and the politicians THEY OWN?  We have the internet, we have twitter, and joined together we have the VOTERS to become a force to be reckoned with.
