The Price Anderson Act makes it impossible for any American homeowner to get insurance to cover losses from a nuclear accident at places like Entergy's trouble plagued Indian Point nuclear reactors that sit atop an earthquake fault. Well, seems that the insurance industry is not going to wait for Congress (as in do nothing but squabble) to pass similar legislation denying property/home owners from getting insurance for harm done from the process of Horizontal Hydraulic Fracturing. Nationwide out of Ohio has announced that they WILL NOT COVER DAMAGES caused by this dangerous extraction method:
The Columbus, Ohio-based company's personal and commercial policies
"were not designed to cover" risk from the drilling process, called
hydraulic fracturing, or fracking, Nationwide spokeswoman Nancy Smeltzer
said Thursday.
The process injects chemically treated water into wells
to fracture shale thousands of feet underground and release trapped gas
or oil. There are rich shale deposits in parts of Pennsylvania, New
York, Ohio, West Virginia and elsewhere.
Health and environmental groups claim fracking can
contaminate drinking water. The gas industry says it's safe if done
properly. Nationwide said risks involved in fracking operations "are too
great to ignore" and apply to policies of commercial contractors and
landowners who lease property to gas companies.
Do we the citizens want to believe an industry KNOWN TO LIE when they say it is doubtful they will be drilling in our community (at least right away), and do we really want a drilling/mining process allowed in our community when we CANNOT GET INSURANCE to cover damages...like the natural gas accident that blew a house off of its foundation earlier this week?

In what is not surprise, seems that the (un) Natural Gas industry's Methane Gas Emissions Study is fatally flawed...actually, that is being overly generous...in my opinion, the (un) Natural Gas Industry's Methane Gas Emissions Study is a document deliberately filled with false and erroneous estimates aimed at hoodwinking the EPA, politicians and members of the general public. At every step of this report which would never pass muster if the API/ANGA had submitted it for peer review, these self serving buffoons went to great lengths to under estimate methane gas emissions from UNCONVENTIONAL Horizontal Hydraulic Fracturing, or FRACKING.
After careful analysis, the nonprofit "Physicians Scientists & Engineers for Healthy Energy (PSE)" slammed the report, labeled it as fatally flawed, framing their remarks in a much more politically correct fashion than is the style of this blog...straight out, the report is BUNK, and the industry is flat out COOKING THE BOOKS to create numbers they want to see, rather than presenting stakeholder communities with the truth, and the actual risks associated with REAL NUMBERS verse the manipulated and false data presented in the report. Some of the fatal flaws include:
The survey pretty much coached those being questioned, indicating/suggesting what answers were sought, led the respondents down the proverbial garden path to the industry's much sought after Garden of Eden where they can rape the earth while claiming it was not them.
API/ANGA's survey targeted, cherry picked their respondents, failing to follow a basic rule of surveys to have/select a random and representative sampling.
Furthermore, the report is highly selective in the information used, the organizations choosing data that is outdated and understated.
Report fails to do a cradle to grave accounting of methane emissions, instead compiling a report that only accounts for a part of the picture, while presenting said report as a full accounting of methane emissions.
As the PSE so eloquently pointed out, the (un)Natural Gas Industry's report is a scam, the report fatally flawed, holding no value, representing no reliability in its supposed facts. What the report does do, is once again proves to the stakeholder communities that the industry will use any means (including fraud) to get their way, to get states to allow them to FRACK our neighborhoods and communities.
This emissions information is critically important because it allows the
companies, citizens, and regulators to gauge the industry’s impact on
the environment and allows companies to measure continued efforts to
reduce their environmental footprint. In reality, the industry COOKED THE BOOKS, and crafted the sampling group to give them the results they wanted, cooked the books to skew the numbers in their favor while wrongfully giving stakeholders false assurances about this every present danger in and around Horizontally Fracked wells.
It is time that a report is done by an INDEPENDENT, UNBIASED group of scientists, rather than having a survey/report done by a organization who has a VERY VESTED INTEREST in hiding the true environmental and health costs of a dangerous industrial practice.

In Aubrey McClendon's quest to corner the (un)Natural Gas shale plays, to push himself upward into a higher ranking of his billionaire status, he has basically conned investors, the general public and America. Chesapeake for far too long now has been selling Whimpy's promise, telling investors "We'll gladly sell you a share of this play or that play, will gladly promise you a percentage of the whole when at some future date when it is drilled, if you give us X Billions of dollars today." McClendon's plan it seems....double down, sell off promises (IE...the company wants to raise $2 Billion by selling a percentage of advanced sales of output in Texas and Oklahoma) of future deliverable s, or better yet, run out the company's cash reserves, deliberate push it into bankruptcy and come out the other end whole while all those who invested in the company take a blood bath.
Sadly, Aubrey McClendon seems to be the poster child for the (un)Natural Gas industry, the whole bloody lot of them prepared to say anything that gets them what they want...the right to FRACK at all costs anywhere and everywhere that shale can be found. They have bought off politicians, spied (illegally) on those who oppose them, and spent tens if not hundreds of millions of dollars on a propaganda campaign worthy of comparisons to Adolph Hitler and the Third Reich. How many of us have seen the commercial where Eric Oswald of Exxon tells us, "...we recognize the challenges, and how important it is to do this right". Exxon and Chesapeake are the two biggest players in the (un)Natural Gas speculation game, the two biggest hucksters trying to sell America and the world on Horizontal Hydraulic Fracturing...can they, and the information they have provided to those who are supposed to be regulating them be trusted?
Chesapeake Energy's financial woes and questionable business practices should lead everyone to one logical conclusion...no, the industry cannot be trusted, and they will NOT GET IT RIGHT. States like Maryland, Ohio and New York should simply pass a BAN ALL HYDRAULIC FRACTURING FOR (un)NATURAL GAS...BAN FRACKING. Problem is, we all know most politicians in positions of authority are as inherently dishonest as the Aubrey McClendon's of the world, each doing their own version of Whimpy as they tell campaign donors, "I will gladly pass laws that favor you when elected if you open up your wallets today."
Take our own governor here in New York...he's already bought into the Natural Gas scam, has already decided that extracting natural gas from the Marcellus Shale is far more important than the health of New York's citizens, far more important than our fresh water supplies, far more important than preserving our state parks and natural resources.
Wake up citizens...Whimpy was a CON MAN, and pretty much everyone involved in the (un)Natural Gas industry is no different than this hamburger guzzling character of Popeye fame.
PS...in breaking news of the too little too late variety....Aubrey McClendon is partially being pushed out at Chesapeake, being stripped of his role as Chairman.
The Medical Waste tracking Act of 1988
defines medical waste as "any solid waste that is generated in the
diagnosis, treatment, or immunization of human beings or animals, in
research pertaining thereto, or in the production or testing of
biologicals." This definition includes, but is not limited to:
blood-soaked bandages
culture dishes and other glassware
discarded surgical gloves
discarded surgical instruments
discarded needles used to give shots or draw blood (e.g., medical sharps)
cultures, stocks, swabs used to inoculate cultures
removed body organs (e.g., tonsils, appendices, limbs)
discarded lancets
So, one might ask, "What does Medical Wastes have to do with Horizontal Hydraulic Fracturing, and the diabolical industrial practice nicknamed Fracking?" As unbelievable as it may seem, the New York DEC plans to treat the waste water streams from fracking along the same lines as Medical Wastes are treated, rather than classifying them for what they are, "Lethal Hazardous Wastes"! Now to understand how ridiculous it for the NY DEC to wrongfully classify and treat Fracking waste along the same lines as Medical Waste, we should look at some of the requirements the US EPA has when a waste is classified as being hazardous...keep in mind, the waste does not have to meet ALL THESE CRITERIA, but instead only has to meet ANY OF THE CRITERIA. Any, as in ONE!
Lets start with Benzene shall we?
The Environmental Protection Agency (EPA) has classified Benzene as a Class A carcinogenic. Benzene exposure can result in the
development of leukemia. Variations of leukemia have been linked to
Benzene exposure, including:
Acute myelogenous leukemia
Acute lymphocytic leukemia
Chronic myelogenous leukemia
Symptoms of Benzene Exposure
People that are exposed to Benzene in high levels or for long periods of time might experience the following symptoms:
Drowsiness
Dizziness
Headaches
Irregular heartbeats
Loss of consciousness
Benzene exposure to the eyes and skin can cause tissue injury and
irritation. Drinking water containing high levels of Benzene can cause:
Stomach irritation
Vomiting
Convulsions
Rapid heartbeats
Death
Guess what folks...benzene is injected underground in hydraulic fracturing, and the
extraction process also causes naturally occurring deposits of benzene
to surface (Hess 1998, EPA Final 2004 4-11). OK, lets try to understand this...Benzene is by US EPA classifications a hazardous waste. The (un)Natural Gas industry injects Benzene into the ground to FRACK A WELL, and when the well has been fracked, even more Benzene is released. Said Benzene gets into the environment (air, water, ground), thus opening up exposure pathways that will see humans exposed to a chemical that is a know cancer causing agent, a chemical that can cause us to lose consciousness, a chemical that CAN CAUSE DEATH...those are some serious medical concerns that all New Yorkers should be concerned with...

So that is why the NY DEC wants to classify and treat fracking wastes as Medical Wastes...said wastes are going to cause us folks serious health issues! ...so that's the thinking? Let's not put all the blame on the NY DEC...the US EPA seems to have blood on its own hands when it comes to being p front and honest when it comes to chemicals in fracking fluids, and the health risks they WILL PRESENT TO US HUMANS.
In a draft 2002 report, EPA reported that at the point of injection,
nine hydraulic fracturing chemicals violated water quality standards
(EPA Fracturing Draft 2002). This assertion was edited out before the
final report was published. The published report did note that
fracturing fluids are likely to remain underground and are “likely to be
transported by groundwater supplies” (EPA Fracturing Final 2004).
So, the (un)Natural Gas industry does not like US EPA findings...no problem, they just get those results edited out, and that changes everything...right? As the Church Lady would say, "Isn't that SPECIAL"? Not to be out done, wanting to get in on all the killing of human beings, Dick Cheney and our United States government jumped into the fray in 2005 solving the issue once and for all by granting the (un)Natural Gas industry an exemption from the Clean Drinking Water Act...much like the NRC does with regulations when the nuclear industry cannot meet standards, GRANT AN EXEMPTION!
In 2005, Congress exempted most hydraulic fracturing from the Safe
Drinking Water Act but said the act would apply to fracturing with
diesel fuel (SDWA Exemption 2005).
Meanwhile, here in our little community we are waiting for Steve Vegliante and the Fallsburg Town Board to let us know when the promised Public Informational Meeting on FRACKING is going to be held as said board considers a proposed ban on fracking for our community...with this kind of information out in the public domain, one has to wonder why the delay...PASS THE BAN! Seriously...can we really trust the DEC to do the right thing, or is our community better off passing a ban on fracking while we still can?
Some other reasons to JUST SAY NO to FRACKING:
Thousands of post-1980 wells are exempt from the Comprehensive
Environmental Response, Compensation, and Liability Act (CERCLA) that
holds most industries accountable for cleaning up hazardous waste.
Thousands of post-1980 wells were exempted from the Clean Air Act, which
limits emissions of nearly 190 toxic air pollutants, including many
emitted by oil and gas companies (Mall et al. 2007, Clean Air Act 2008).
Thousands of the nearly 270,000 wells drilled in the West since 1980 are
exempt from the federal Emergency Planning and Community Right to Know
Act of 1986.
The nearly 270,000 oil and natural gas wells drilled in the West since
1980 have enjoyed an exemption from the federal Resource Conservation
and Recovery Act (RCRA), passed in 1976 to establish a cradle-to-grave
hazardous waste management program (RCRA History).
Are you starting to see a TREND HERE? The (un)Natural Gas industry has been exempted from almost every rule meant to protect human health and the environment, has been exempted from almost every law that could and should hold them legally liable when they screw it all up, which they certainly will do. Give Steve Vegliante a call, tell him the time for Fallsburg to pass a fracking ban IS NOW.
Make no bones about it...Governor Cuomo has fracked gas on his hands, frack money in his pockets, and rosy red lips from kissing to much gas ass...he is trying to force through fracking regulations that fall far short of protecting our communities, and we in the Anti-Fracking Camp are trying to stop him and the (un)Natural Gas industry that has spent tens of millions of dollars here in New York on FALSE ADVERTISING...propaganda that is.

After attending the Senate Fracking Forum in Albany yesterday, I thought
it essential to reach out to you at this critical time. Despite the
proliferation of questions regarding health and safety, Governor Cuomo's
administration is poised to finalize regulations that would allow
fracking in New York, and we must stop it!Will you add your name to the letters urging our elected officials to support a ban on fracking?
My colleague, Eric, sent the below email to you back in February asking
for you to take action. Since then, many legislators have stepped
forward in support of legislation to ban fracking; yet others are still
under the impression that we would be able to regulate this mess. How
can we regulate a process that still poses more questions than answers?
Regulations aren't free. They cost the public money and they tie up government personnel. Wouldn't it be better to invest in a clean energy future and Ban Fracking Now?

Why Fallsburg MUST Ban Fracking...would you want this for your children?
Stuff Happens...too often with fracking.
Just a heads up for all those within the "Town of Fallburg" geographical footprint...Fracking is on the agenda, and I will be asking the town to consider passing a complete ban on the industry practice known as Hydraulic Fracturing. I would encourage all those opposed to fracking to find the time to be there...Fracking is on the agenda at exactly 6 PM.
Below is text of the presentation:
Members of the board for the town
of Fallsburg, attending members of the public, I am here tonight asking you to amend
our zoning rules and regulations to ban Hydraulic Fracturing and its various
and assorted related activities within the geographical footprint of the town
of Fallsburg. Some folks, including
members of this board, in my opinion would see such a ban as un-necessary,
their belief based upon natural industry studies that claim our area of
Sullivan County is not likely to see fracking due to the shallow nature of the
Marcellus Shale in our immediate area.
Simply stated, not likely is a
very ambiguous phrase with enough room to drive a fleet of trucks filled with
contaminated fracking fluids through, and at some point, the Natural Gas
industry will do exactly that in some way, shape or form if we as a community
do not take the steps necessary now to protect ourselves, our community, our
environment, and our fresh drinking water supplies.
The industry is spending tens of
millions of dollars in what amounts to a propaganda campaign. They promise hundreds of thousands of jobs,
they promise us cheap energy, and most importantly, they promise us that the
job will be done right.
First, there will not be hundreds
of thousands of jobs, and the jobs created will not see hundreds, let alone
thousands of Sullivan County citizens hired...the industry has a funny way of
counting, used what could be called fuzzy math in calculating how many jobs
will be created…if a local diner starts using say natural gas, the industry
would want to claim that the job of dishwasher was a job created as a result of
their industry. If there is a major
explosion at a well pad that causes serious injuries to someone, and that
someone going forward required home health care, the Natural Gas industry will
say even that accident CREATED JOBS.
Cheap energy? We all know the basic rule of supply and
demand. The natural gas industry is
getting government at all levels to hand out our tax dollars in the name of
Natural Gas and cheap energy, the state of Pennsylvania as example doling out
almost $50 million to communities to change over their fleets to Natural Gas…well,
as the demand begins to rise, so will the price, and it will not be too far
down this path before we are paying $4.00 a gallon for Natural Gas, just as we
pay $4.00 a gallon now for gasoline. In
the not so long haul, cheap fuel/energy promised by those wanting to frack our
communities is a myth.
They promise the job will be done
right. Fact is, much like the waste from
the nuclear industry, the Natural Gas industry does not know what to do with
their own wastes, literally billions upon billions of gallons of chemically
contaminated and radioactive water.
Right now, they want to either A) inject it into the ground…problematic
from several standpoints including a belief by some including the Ohio EPA that
said injection is causing earthquakes, or B) they want to haul the water off
too local sewage treatment plants for treatment, then have said water dumped
into our rivers and streams.
A simple Google search will show
all of us numerous examples of problems with fracking…what you will find is
three things that stand out.
1. There are a lot of accidents, from well blow
outs, faulty valves, too busted lagoons that were meant to hold the
contaminated water. There are numerous
examples of contaminated wells, and for
every accident, every contaminated water supply, the industry in every
case claims it is not responsible, is not the guilty party.
2.Lots
of excuses as everyone in the industry wants to blame it on someone or
something else. It was human error, it
was an equipment malfunction, it was MOTHER NATURE!
3.Lots
of attorneys, who acting as Natural Gas industry hired guns look at ruined
communities and say, “PROVE IT WAS US”.
The big question seems to be, can
the natural gas industry extract all the gas that is supposed to be in the
Marcellus Shale, and do it safely. Their
own industry experts admit that Hydraulic Fracturing is not without risk…which
brings us to the central point of why I am asking this board to ban
fracking. We as a community cannot
afford those risks, nor can we afford the costs should fracking come to our
community. Furthermore, our own laws as
written make it apparent that Natural Gas drilling and its associated
industrial acts and process does not fall into the town of Fallsburg land use
plans, and not passing a ban on fracking should raise the question, “Are those
elected officials sworn to uphold our town laws and to protect our citizens
derelict in their duties”?
The Town of Fallsburg Zoning Code as adopted in Article 1, Section 310-1.2 specifically
instructs the town in sections A-E, charges the towns elected officials and
employees with the following duties and responsibilities:
To preserve the character and rural
scenic beauty of the landscape and protect this gateway to the Catskill Forests
from inharmonious and destructive uses of land; (emphasis added)
Create
an orderly pattern of growth by encouraging
concentration of new residential development (emphasis added) in areas that
can conveniently be serviced with public facilities and discouraging intensive
residential development in areas of difficult accessibility that would involve
excessive costs for road improvements, road maintenance, school bus
transportation and utility installation;
Regulate
population density to reflect the desired character of the Town;
Prevent intrusion of incompatible
uses into residential areas, by establishing proper standards for improvements
in new residential developments and preserving, protecting and enhancing
natural beauty wherever possible; (emphasis
added)
Provide for open spaces and to
preserve the natural and scenic qualities of lands; (emphasis added)
Furthermore, the town of Fallsburg Zoning Code in Chapter 141 Fresh Water Wetlands in Section 141-1 specifically instructs the town, charges the town’s
elected officials and employees with the following duties and responsibilities:
The purpose of this chapter is to
provide for the protection, preservation and conservation of the freshwater
wetlands within the boundaries of the “Town of Fallsburg”, pursuant to and in
accordance with all of the proceedings, concepts and definitions set forth in
Article 24 of the Environmental Conservation Law and Title 23 of Article 71 of
such law relating to the enforcement of Article 24, as such law may from time
to time be amended.
Everything about hydraulic
fracturing runs contrary to these charges you as a board have been given, and
changing our zoning rules and regulations to ban FRACKING would in fact fit harmoniously
into the towns stated goals as relates to land use in our geographical
footprint. Furthermore, though it is
freely admitted that our town does not have the right to regulate the industry,
two recent court decisions have shown that we and every community in the state
of New York do have the right to REGULATE LAND USE, and a ban on fracking in
Fallsburg would be exactly that…regulating land use. Moreover, for various reasons, now is the
time to pass such a zoning ordinance into law.
1. My own investigations lead me to believe that
right now there are no lands in our community with Natural Gas leases (using horizontal
hydraulic fracturing) on them. This means
passing a bill now banning fracking rather than later when and if there would
be leases eliminates the towns worry that they could be subject to a takings
act…this point was discussed with an attorney with the “Natural Resources
Defense Counsel”
2.When
and if it is proven by the Natural Gas industry that they can extract natural
gas from the Marcellus Shale safely, and without contaminating our air, water
and land, the town could consider changing the ordinance that bans fracking,
but it is prudent right now for us to take steps to protect ourselves…it would
be too late down the road if we found out fracking was coming to our community
to take such protective measures.
3.Passing
such a ban would send a clear signal to the world that Fallsburg cares more
about clean water, a pristine environment, breathable air and people’s health
than it cars about the profits of companies like Cabot Oil, Exxon and
Chesapeake Energy, and that in turn has the very real chance of seeing truly green
businesses and industry giving us a closer look when they are looking for a new
community in which to locate their business.
Fallsburg has nothing to lose in
passing such a ban on fracking, but everything to lose if this board fails to
pass such a ban, and months or a couple years later Hydraulic Fracturing finds
its way into our community. Therefore, I
am asking you to pass the ban on fracking I am requesting on behalf of all
those citizens opposed to Hydraulic Fracturing in our community, and am asking
you to use the frame work included in this document.

Proposed Amendments to Town of
Fallsburg Zoning Ordinance
The Town of Fallsburg Zoning Ordinance is herby amended as
follows:
1. Section (insert proper section) Definitions is
amended by adding new definitions to read as follows:
“Natural Gas” shall mean any gaseous
substance, either combustible or noncombustible, which is produced in a natural
state from the earth and which maintains a gaseous or rarified state at
standard temperature and pressure condition, and/or gaseous components or vapors
occurring in or derived from petroleum or other hydrocarbons.
“Natural Gas and/or Petroleum
Exploration” shall mean geologic or geophysical activities related to the
search for natural gas, petroleum or other subsurface hydrocarbons including
prospecting, geophysical and geologic seismic surveying and sampling
techniques, which include but are not limited to core or rotary drilling or
making an excavation in the search and evaluation or natural gas, petroleum, or
other subsurface hydrocarbon deposits.
“Natural Gas and/or Petroleum
Exploration and Production Materials” shall mean any solid, semi-solid, liquid,
semi-liquid or gaseous material used in the exploration or extraction of
natural gas.
“Natural Gas Exploration and/or
Petroleum Production Wastes” shall mean any garbage, refuse, cuttings, sludge,
flow-back fluids, produced waters or other discarded materials, including
solid, liquid, semi-solid, or contained gaseous material that results from or
is associated with the exploration, drilling or extraction of natural gas
and/or petroleum.
“Natural Gas and/or Petroleum
Extraction” shall mean the digging or drilling of a well for the purposes of
exploring for, developing or producing natural gas, petroleum or other
subsurface hydrocarbons.
“Natural Gas and/or Petroleum Support
Activities” shall mean the construction, use, or maintenance of a storage or
staging yard, a water or fluid injection station, a water or fluid gathering
station, a natural gas or petroleum gathering line, venting station, or compressor
with the exploration or extraction of natural gas or petroleum.

treat natural gas; or to dispose of natural gas exploration or production
wastes; or to erect any derrick, building or other structure; or to place any
machinery or equipment for any such purposes.
B)Prohibition against the Storage,
Treatment and Disposal of Natural Gas and/or Petroleum Exploration and
Production Materials.
No land in the Town (and it
geographical/governmental outlaying footprint) shall be used for: the storage, transfer, treatment and/or
disposal of natural gas and/or petroleum exploration and production materials.
C)Prohibition against the Storage,
Treatment and Disposal of Natural Gas and/or Petroleum Exploration and
Production Wastes.
No land in the Town shall be used
for: the storage transfer, treatment and/or disposal of natural gas and/or
petroleum exploration and production wastes.
D) Prohibition against Natural Gas and/or Support
Activities.
No
land in the Town shall be used for natural gas and/or petroleum support
activities.
3.These
amendments shall take effect upon adoption and publication as provided by law.

On Monday, April 16th, 2012 at 6:00 I will be officially asking the "Town of Fallsburg" to pass a zoning ordinance that would BAN FRACKING. It is my understanding that Steve Vegliante and the board are more than willing to issue a proclamation against FRACKING, but that is inadequate. If you oppose fracking, PLEASE ATTEND this important board work session meeting and SHOW YOUR SUPPORT for a zoning ordinance that would ban fracking in our community. Rumor has it...and at this point, it is just RUMOR that we here in downtown Mountaindale might be getting a convenience store...more on this HUSH HUSH story as it becomes available.
For those who are wondering...the Mountaindale Inn is officially opened for the season, and the first "Open Mic" night this past Wednesday was a HUGE SUCCESS! Rumor has it that we have new banners coming...find myself wondering, what happened to the Banner Design Contest? Seeing as the winnings from the "Train Garden" project from last year that Sullivan Renaissance awarded second place to are paying for these new banners, just wondering how it is that I missed the CONTEST? Who WON? Is the new town slogan suggested by our own talented local artist, Raymon Elozua being incorporated?...so excited to see these banners appearing around town, and of course anxiously awaiting the newly rebuilt/designed flower boxes as well. Mountaindale in late spring when the flower boxes are out really looks quaint, and of course the hanging baskets incorporated as a part of last summers winning Renaissance Project really made Main Street POP.
New Historical Signage For Rails to Trails Corridor
With all the new businesses in town, with all the talk of more coming, find myself wondering if any other local business owners and business people would be interested in forming a "Downtown Mountaindale Business Association"? Thinking if we could get it up and running before next February that it would be nice to apply for a Sullivan Renaissance Beautification Grant since there seems not to be a project going on this year. Love to see Anderman Oil, Robinhood Realty , Hospitality Green and some of our other major hamlet businesses such as the Mountaindale Inn run with such a project/business group. With the newly finished "Historical Signs" and the almost completed brochure for our "Rails to Trails" corridor, this seems like and opportune time for such a group to come into existence.
One last local news reminder!....GIRL SCOUT COOKIES are coming in supposedly this COMING WEEK! I already have my own case ordered, but maybe I should get a second one!
OK, tired of brisk, lets get on with Spring time. The sun is out, the sky is blue, but with the wind it is still a bit nippy out, the weather seeming more like a day in mid March than a spring day in April. For the week, word of the day seems to be cloudy, so look for rain in our forecast here in downtown Mountaindale New York.
Seems that our little hamlet is about to become the travel to place for food if the scuttlebutt in town is all for real. Mountaindale's first restaurant, Ed's Mountaindale Inn is just about to open for the season...they have been serving lunch this week as they do a shake down of the place. For the coming summer season Ed is boasting a brand new lunch menu, and the bar restaurant is looking pretty good with a complete new coat of paint inside. If you are looking for a really good burger and a cold beer after a round of golf, stop by and say hello. For all our local musicians, look for the Wednesday Night Open Mic to be back up and running around the 18th of April!
Around the corner, seems that Chef Robert over at Uccelli's Restaurant also has some big plans afoot. First up, a new 16x16 deck is going to be built so that patrons can dine outside. His establishment will now be open six days a week, and serving brunch on Sundays, as well as a lunch menu Tuesday through Saturdays. I've seen the menu, and there are some tasty treats waiting to be tried. Wish he would get a beer and wine license, but if you are looking for some really good food with a Northern Italian flair, dinner at his place is worth the trip over.
In other news of a local nature...Fracking is on the "Town of Fallsburg" agenda for their April 16th work session. I would encourage everyone OPPOSED to Fracking to show up and encourage our board to amend our zoning rules/regulations to ban fracking within the geographical footprint of our town including or small hamlet of Mountaindale.
Drove by Skyway on my way to Ellenville, and it seems they have started the task of getting the campground up and ready for the season which opens on May 1, 2012. There is also camping available here in our hamlet at our own Mountaindale Park, and then there is also Morningside.
Also, please join the petition drive asking Walmart to stop purchasing Monsanto's genetically altered sweet corn. The petition can be found here. It is also suggested that you not buy sweet corn (corn on the cob) from Walmart until such time as they assure the buying public that the corn being brought in is not grown with Monsanto's genetically altered seed.
So you want to allow FRACKING? One of the toxic additives in Fracking Fluid is "Distillates, petroleum, hydrotreated light according to the voluntary disclosure site (keep in mind the industry is hiding most of the chemicals they use under the guise of TRADE SECRETS). Anyway, lets look at some of the inconveniences/negative health effects of one of the MILDER chemicals used in the lethal mix.
Mineral turpentine is a hydrotreated light distillate of petroleum, and consists of a complex mixture of highly refined hydrocarbon distillates mainly in the C9-C16 range. The material is a colorless transparentliquid at room temperature, and immiscible to water. The liquid is highly volatile and the vapors are flammable. It can be a very dangerous inhalant. (NOTICE THAT FLAMMABLE PART?)
Inhalation
Can cause dizziness, headache, drowsiness, nausea, unconsciousness (NIOSH)
Skin
Dry Skin (NIOSH)
Ingestion
Can cause cough, diarrhea, sore throat, and vomiting (NIOSH)
Environmental Effects
The National Institute for Occupational Safety and Hazard states that it is harmful to aquatic organisms.
So, inhalation could affect any of us, as well as our pets, livestock, and every bird and animal that happens to be around. The skin issue...sure that the Natural Gas industry will want to consider this as nothing more than a MINOR inconvenience to those so afflicted, a small price to pay for supposedly cheap energy. Ingestion...face it folks this stuff could (will) get into our water, and perhaps into our food chain, so it is not out of the question, and cannot speak for anyone else, but I do not want to be coughing while sitting on the toilet holding a pot so I can vomit. Environmental Effects...harmful to aquatic organisms...that is jargon for DEATH, death of the basic building blocks of our aquatic food chain.
Ask yourselves...at what cost Natural Gas, 50 percent of which is going to end up going to China?
In news just in from Colorado, seems that our food chain is now officially THREATENED by the push for Natural Gas using the dangerous industrial practice that is commonly referred to as FRACKING. We already know that fracking will poison our water...well, farmers in Colorado who in the past have been the winning bidders for unallocated water were outbid by Natural Gas bidders...which means the water our farmers rely upon for crops is NOT THERE, is now OWNED BY FRACKING COMPANIES.
Northern Water Conservancy District runs the auction which sells off unallocated water from the Colorado River Basin, and the bidding is open to any one who has a beneficial use for the water...so, polluting some 500,000 to 5 million gallons of water (per well) with lethal and cancer causing chemicals, pumping it thousands of feet down into the ground to EXPLODE ROCKS is a BENEFICIAL USE? Furthermore, that water which would normally feed back into the environment is LOST FOREVER, unlike water used to water crops that in turn feed people.
Also not factored into this equation...farmers were outbid at the auctions, so there is the reality of lost food sources, but as prices for this dwindling resource (FRESH POTABLE WATER) continue to soar as the (un)Natural Gas industry demand for water increases, there is the very real fear of the price for food going up to a point where folks just will not be able to afford to buy it. In just one year the price for the water at this particular auction has risen on average six dollars per acre-foot from $22 last year, with some of the (un)Natural Gas industry's winning bids going as high as $35.
Ask yourselves America...are you willing to pay higher prices to feed your family so that companies like Cabot, Exxon and Chesapeake Energy can ship Natural Gas overseas to China? Are you willing to see streams, rivers and lakes sucked dry in the name of oil and gas company profits?
This is a fight that average Americans can win, but only if we all join forces and speak with a united voice at every level of government. Right now, a letter is sitting at the townhall in Fallsburg, NY. Said letters asks Steve Vegliante and the town board to ban fracking in our small community...every community in America, the citizens in those communities should be seeking similar bans.
If you live in the geographical footprint of the town of Fallsburg, contact Steve Vegliante, ask him and the other board members to move forward in changing our zoning laws to ban fracking. Write letters to the editor, call your local, state and elected officials asking that they ban the practice of fracking. Get involved before it is too late...the cost to our environment, water supplies and our health is too great, and as this latest story shows, get involved in this battle before you cannot even afford to feed your children.

First, the weather outside is so stunningly beautiful and spring like...temperatures up into the 70's, the sun shining as birds chirp on the electrical wires just outside my apartment window. Look for the temperatures to remain unseasonably high over the next few days with rain moving into our forecast overnight. Today was a perfect day for a walk along our Rails to Trails corridor. Speaking of which, the picture is of the new signage that will be going up on the trial in the next few weeks thanks to a grant from "Parks and Trails New York".
In local news of a Saint Patrick's Day sort, Ed opened up the Mountaindale Inn for the celebration, and all who attended had a wonderful time. Our lone local bar will be opening full time for the season starting April 1st, and looks as if the Wednesday Night Open Mic will be returning...we are all looking so forward to that. In other festivities for the day, Marc and Kelsey held a small celebration of their own, and rumor has it that the food was FIVE STAR. Also heard it through the grape vine that the High School's performance of "Grease" was sterling.
Seems that North Carolina Governor Bev. Perdue has done a 180 degree turn and is now shilling (prostituting) for the Natural Gas industry, now embracing the FRACKING technology she has so recently opposed and vetoed. Wonder how much she got paid?
Seems that Puerto Rico was not happy with Santorum tellling its citizens to LEARN ENGLISH if they want to become America's 51st state...they have overwhelming voted for Scrooge McRomney in today's primary. In this case, I go with Santorum...if you do not want to speak OUR LANGUAGE, don't live in America, or in this case become the 51st state. Contrary to what Puerto Rico seems to think, WE DO NOT NEED THEM, and to be honest, letting them become a state is going to cost the rest of us here in America so SERIOUS MONEY.
NYPD THUGS again oust Occupy Movement protesters from Zuccotti Park...it would serve NYC well to remember that spring is fast approaching, and with that better weather look for ranks of protesters to swell as dissatisfied Americans challenge the police and their guerrilla warfare tactics. At some point, the police and their weapons will be no match for crowds in large enough numbers to be an overwhelming force as "We the people" demand change.
Told you so....about two weeks ago I scoffed at the deal made with North Korea, said sending them food was a wasted effort as they would break their promises...well, two weeks later...BINGO, North Korea is going ahead with missile testing. We have the bombs...lets use a few of them on both North Korea, and in Iran. Like it or not, these countries will only respect an iron fist.
At the next Town of Fallsburg executive session FRACKING is going to be on the table for discussion...more specifically, a BAN ON FRACKING, which this blog and this write supports. Why is this item on the agenda you might ask? Because I have asked the "Town of Fallsburg" to amend our zoning regulations to ban not just the act of fracking, but all of its sundry processes including disposal of fracking fluids in our community.
Now the conventional wisdom on the board is "We do not need such a ban, it is highly unlikely the industry would want to frack in our community anyway." OK, but what if they do? Surely the board is familiar with the old saying, "A ounce of prevention is worth a pound of cure."? If the industry has no real interest in doing any fracking in our community, what is the harm in having a ban ALREADY IN EFFECT?
The Town of Fallsburg covers a pretty big area when you start looking at the sum parts of the whole...IE, it includes our little hamlet of Mountaindale, all of our beautiful streams, water falls and SAFE DRINKING WATER SUPPLIES. Wouldn't it make more sense to put a ban in effect...just in case the (un)Natural Gas industry and their biased experts are LYING TO US?

Letter Seeking Ban
Dear Town of Fallsburg Board:
The Town of Fallsburg Zoning Code as adopted in Article 1, Section 310-1.2 specifically
instructs the town in sections A-E, charges the towns elected officials and
employees with the following duties and responsibilities:
To preserve the character and rural
scenic beauty of the landscape and protect this gateway to the Catskill Forests
from inharmonious and destructive uses of land; (emphasis added)
Create
an orderly pattern of growth by encouraging
concentration of new residential development (emphasis added) in areas that
can conveniently be serviced with public facilities and discouraging intensive
residential development in areas of difficult accessibility that would involve
excessive costs for road improvements, road maintenance, school bus
transportation and utility installation;
Regulate
population density to reflect the desired character of the Town;
Prevent intrusion of incompatible
uses into residential areas, by establishing proper standards for improvements
in new residential developments and preserving, protecting and enhancing
natural beauty wherever possible; (emphasis
added)
Provide for open spaces and to
preserve the natural and scenic qualities of lands; (emphasis added)
Furthermore, the town of Fallsburg Zoning Code in Chapter 141 Fresh Water Wetlands in Section 141-1 specifically instructs the town, charges the town’s
elected officials and employees with the following duties and responsibilities:
The purpose of this chapter is to
provide for the protection, preservation and conservation of the freshwater
wetlands within the boundaries of the “Town of Fallsburg”, pursuant to and in
accordance with all of the proceedings, concepts and definitions set forth in
Article 24 of the Environmental Conservation Law and Title 23 of Article 71 of
such law relating to the enforcement of Article 24, as such law may from time
to time be amended.
It is the belief of the majority of citizens who reside,
recreate and travel through the geographical footprint of the “Town of Fallsburg”
that allowing the industrial practice of Hydraulic Fracturing (fracking) for
exploration of, and drilling for Natural Gas runs contrary to these and other
sections of the “Town of Fallsburg” Zoning Rules and Regulations. It is further believed that any elected
official of the “Town of Fallsburg”, any employee of the Town of Fallsburg who
would support the industrial practice of Hydraulic within the scope of their
OFFICIAL DUTIES (emphasis added) would be violating their “Oath of Office
and/or Terms of Employment”.
Recent court cases here in the state of New York related to
local ordinances seeking to ban the industrial process of Hydraulic Fracturing
(fracking) have seen local ordinances upheld, with the judges in two recent
cases ruling that such bans are legal, a natural extension of a
community's local government right and responsibility to control land use. A amendment to the “Town of Fallsburg”
Zoning Rules and Regulations, banning the industry practice of Hydraulic
Fracturing (fracking), based upon these recent court decisions, would not be a frivolous waste of the town
board’s time, but in fact would serve to preserve our safe drinking water
supplies, our communities, and preserve the character and rural
scenic beauty of the landscape and protect this gateway to the Catskill Forests
from inharmonious and destructive uses of land (emphasis added).
As a citizen of the hamlet of Mountaindale which lays within
the geographical and governmental control of the Town of Fallsburg, I am
respectfully requesting that the town board take all necessary steps to enact
changes as more fully outlined in the below proposed amendment into the “Town
of Fallsburg Zoning Ordinance”.

E)Invalidity of Permits. No
permit issued by any local, state, or federal agency, commission or board for a
use which would violate the prohibitions of this section or of this ordinance
shall be deemed valid within the town (and it geographical/governmental
outlaying footprint).
3.These
amendments shall take effect upon adoption and publication as provided by law.
